1. Seller and scope

5mstart is operated by KOIL CONTENT CREATION PTY LTD, Australian Company Number 634054309, registered in Docklands VIC 3008, Australia, with an operating address at Welfenstraße 1, 76137 Karlsruhe, Germany. These terms govern purchases of individually configured FiveM server packages (digital content, delivered as a download) from fivemstart.com. Contact: [email protected]. 2. Contract and order confirmation

The configurator and the prices shown there are an invitation to place an order. By clicking the "Buy now" button on the review step you make a binding offer for the configuration you put together. A binding contract is formed when 5mstart accepts the order by sending an order confirmation or by making the server package available for download. We may refuse or cancel an order where payment is not authorised, a component is unavailable, the price is clearly erroneous or the transaction presents a substantiated fraud or abuse risk. Any charged amount for a cancelled order will be returned through the original payment route.

3. What you get and licence

We provide a FiveM server package configured to your selection: a server base for QBCore or ESX, the scripts you selected, dependencies added automatically, a pre-configured server.cfg and the database (SQL) files, delivered as a ZIP download. Unless expressly stated otherwise, the purchase grants you a limited, non-exclusive, non-transferable right to use the delivered files for your own FiveM server or project. The purchase does not transfer copyright or ownership of the files. Resale, redistribution, publication of source files, sharing download access, removing licence controls or using the files to infringe third-party rights is prohibited. Script-specific licence terms shown before purchase take precedence where they provide more specific rules.

4. Product information and compatibility

The configurator and the order review are the source of truth for the package contents, the supported framework, dependencies and technical requirements. Hosting, the FXServer software, a Cfx.re licence key and a database are not part of the package. Please check the requirements and test changes in a staging environment before using them on a live server. 5mstart does not promise compatibility that is not expressly stated.

5. Prices and payment

All prices are final prices including statutory VAT. The binding total is calculated by our server and shown at checkout. Payments are processed by the payment provider presented at checkout (Stripe). 5mstart does not store full payment-card numbers.

6. Delivery and account access

After successful payment your server package is built automatically and made available for download in your account on fivemstart.com; you also receive an email. A finished build can be downloaded for 30 days. You can rebuild your package from your account within the limits shown there (currently up to 3 rebuilds per day). You must provide a working email address and protect access to your account. Missing or inaccessible downloads should be reported to support with the order details, without sending payment-card data.

7. Updates and support

Support covers the package and scope described in the configurator. Updates, future compatibility and response times are included only where expressly stated. Support does not include custom installation, hosting or development unless separately agreed.

8. Right of withdrawal and statutory rights

Consumers generally have a right of withdrawal; details are in the withdrawal information. For digital content the right of withdrawal expires once we have started performing the contract after you expressly agreed that we begin before the withdrawal period ends and acknowledged that you thereby lose your right of withdrawal (§ 356 (5) BGB). You give this consent on the review step before buying. Nothing in these terms excludes rights that cannot lawfully be excluded.

9. Defects and liability

If delivered files are missing, corrupt or materially different from the configuration you ordered, contact support so we can investigate and provide a repair, replacement or remedy required by law. Liability for intent, gross negligence, injury to life, body or health, fraud and mandatory product or consumer law remains unaffected. For ordinary negligence, liability is limited only to the extent permitted by applicable law.

10. Third-party rights and reports

Third-party names and marks remain the property of their owners. Listing a script does not by itself imply endorsement. Rights holders and customers can report inaccurate attribution, unauthorised distribution or other legal concerns to [email protected] with the affected details. We may hold or remove a script while evidence is reviewed.

11. Misuse

Users must not attack the service, bypass access controls, automate abusive requests, use stolen payment credentials, share buyer-only downloads or use 5mstart to violate applicable law. We may restrict access where reasonably necessary to protect customers, rights holders or the service, while preserving mandatory buyer remedies.

12. Privacy

Our Privacy Policy explains how account, order, payment, support and security data is handled.

13. Governing law and disputes

These terms are governed by the laws applicable to the operator, without depriving consumers of mandatory protections granted by the law of their habitual residence. Mandatory courts and dispute rights remain unaffected. Please contact support first so that an order or delivery problem can be investigated promptly.

14. Changes and severability

The terms accepted at the time of purchase govern that order. We may update these terms for future orders when the service or law changes. If one provision is invalid, the remaining provisions continue to apply to the extent permitted by law.
